ORDER
This writ petition is filed seeking direction to the the 2nd Respondent to measure the Petitioners land plot No 28 in S.NO 684/2A 2B as per the letter written by the 1st Respondent bearing NA.KA.NO 2117/2019/F1 dated 7.5.2019.
2. The case of the petitioner is that the petitioner is the absolute owner of the plot No.28 in S.No.684/2A, 2B the unapproved layout. The third respondent has tried to encroach the petitioner's land. Hence, he gave a representation to the first respondent to measure the land and remove the underground sewerage pipiline. However, the respondents have not considered the same so far. Without having no other option, the petitioner has filed the present writ petition before this Court.
3. The learned counsel for the petitioner submitted that this Court may issue a suitable direction to the first respondent to consider the petitioner's representation and pass appropriate orders within the time stipulated by this Court.
4. The learned counsel appearing on behalf of the respondents submitted that the petitioner's representation will be considered and suitable orders will be passed on merits within the stipulated period as fixed by this Court.
5. Heard both sides and perused the materials available on records.
6. Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without going into the merits of the case, direct the second respondent to consider the petitioner's representation and take necessary steps to measure the land and pass appropriate orders on merits and in accordance with law, after providing opportunity to the petitioner as well as the 3 rd respondent, as expeditiously as possible, if not already measured.
7. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
