The petitioners who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 408, 120B, 471, 477 of IPC in Crime No.1 of 2024, seek anticipatory bail.

2. The case of the prosecution is that on the basis of the Audit Report dated 17.06.2021, it was found that the petitioners misappropriated the funds of the society. Hence, the complaint.

3. The learned counsel for the petitioners submits that the petitioners are innocent persons and they have not committed any such offence as alleged by the prosecution. He has submitted that a false case has been foisted against them. Hence, he seeks anticipatory bail.

4. The learned Government Advocate (Crl.Side) would submit that the investigation is pending and at this stage if the petitioners are let on Anticipatory Bail, there is every possibility of tampering the evidence and threatening the witnesses. Hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the rival submissions on either side and considering the gravity of the offences and also considering that investigation in this case is not yet completed, This Court is not inclined to grant Anticipatory Bail to the petitioners at this state.

6. Accordingly, the above Crl.O.P. stands dismissed. No costs. 09.08.2024 shr
