O R D E R

This criminal original petition has been filed to cancel or modify the condition of depositing Rs.1,50,000/- imposed in the order dated 14.10.2016 in Crl.M.P.No.3049 of 2016 on the file of the Chief Judicial Magistrate Court, Erode.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is seen that this petitioner was arrested in Cr.No.13 of 2016 by the respondent police and was remanded to custody on 27.09.2016. In Crl.MP No.3049 of 2016, the petitioner was granted bail by the Chief Judicial Magistrate, Erode on certain conditions one of which is "the petitioner is directed to deposit a sum of Rs.1,50,00/- before this Court". Aggrieved by the aforesaid condition, the petitioner is before this Court.

4. It is seen that in Crl.OP.No.23287 of 2016, this Court, by order dated 20.10.2016, has reduced the sum of Rs.1,50,000/- to a sum of Rs.1,00,000/- https://hcservices.ecourts.gov.in/hcservices/

5. In the light of the above, the aforesaid condition imposed by the Chief Judicial Magistrate, Erode, is modified and instead of Rs.1,50,000/-, the petitioner shall deposit a sum of Rs.1,00,000/- and on such deposit, the same shall be deposited in a Nationalized Bank, so that it accrues interest and that amount could be disbursed by the trial Court at the end of the trial, in accordance with law. Rest of the conditions imposed by the Chief Judicial Magistrate, Erode shall remain the same. With the above directions, the Criminal Original Petition is closed.
