Prayer : Criminal Revision filed Sections 397 and 401 of Cr.P.C., r/w under Section 438 r/w 442 of BNSS Act, to enhance the maintenance amount from Rs.8,000/- to Rs.15,000/- to the 1st petitioner herein from 01.12.2015 (date of filing M.C.) ordered in M.C.No.07 of 2016 on 05.01.2024 on the file of II Additional Principal Family Court, Chennai and also direct the respondent to continue to pay all the academic expenses, other incidental expenses towards extra curricular activities, fees towards badminton and singing classes etc, present and future to the 2nd petitioner herein. ORDER

The criminal revision has been filed by the wife and her minor daughter/petitioners, aggrieved by the quantum of maintenance awarded by the trial Court.

2. The trial Court by an impugned order, had awarded a maintenance of Rs.8,000/- (Rupees Eight Thousand only) to the first petitioner and Rs.20,000/- (Rupees Twenty Thousand only) to the second petitioner, totalling Rs.28,000/- per month. Admittedly, the respondent is regularly paying the said maintenance amount to the petitioners.

3. Mr. R. Manoharan, the learned counsel for the petitioners, would submit that the first petitioner is incurring an annual expenditure of Rs. 75,000/- (Rupees Seventy Five Thousand only) towards the school fees for the second petitioner.

4. Ms. R. Bhuvaneswari, the learned counsel for the respondent, on instructions, would submit that the respondent is willing to pay the said fees.

5. In view of the same, the impugned order is modified to the extent of directing the respondent to pay Rs.75,000/- (Rupees Seventy Five Thousand only) in the first week of May every year, together with the maintenance amount awarded by the trial Court.
