This Sub Application has been filed to permit the petitioner to deposit the balance 75% plot cost as per the allotment order dated 31.10.2023 by way of demand draft dated 22.05.2025 by extending the time fixed in the order dated 19.03.2025 passed by this Court in Cont.P.No.3568 of 2024. 2.

It is seen that this Court by an order dated 19.03.2025, while closing the contempt petition in Cont.P.No.3568 of 2024, granted liberty to the petitioner to avail financial facilities from any one of the financial institution not only from the Tamil Nadu Industrial Investment Corporation (TIIC) on the strength of the no objection certificate issued by the respondents. Further, the petitioner shall have to avail financial facilities and to pay remaining amount to respondents within a period of sixty (60) days from the date of issuance of no objection certificate ie., from 10.03.2025. 3.

The learned counsel appearing for the applicant submitted that

there was a delay of 13 days to comply the order passed by this Court dated 19.03.2025. The delay was caused due to non-availability of financial assistance. He also produced a Demand Draft for the balance amount of 75% of the plot cost viz., for Rs.2,41,00,000/- dated 22.05.2025. He further submitted that the petitioner is also ready and willing to pay reasonable interest for the delay.

The learned counsel appearing for the respondent vehemently objected to receive 75% of the plot cost as per the allotment order, since the cost of the plot increases and differentiate cost of the plot to be paid by the petitioner.

Considering the above facts and circumstances, this Court is inclined to extend the time by two weeks from today. The petitioner shall pay further sum of Rs.4,00,000/- (Rupees four lakhs only) apart from 75% of the plot cost viz., Rs.2,41,00,000/-. It is made clear that the petitioner shall pay the total sum of Rs.2,45,00,000/- on or before 16.07.2025 failing which, the respondents are at liberty to cancel the order of allotment and return

whatever amount deposited by the petitioner to deal with the property. 6.
