.. Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus to direct the respondents to allot a housing plot in favour of the petitioner, and for consequential orders.

O R D E R

The petitioner is a distinguished sportsman, who has won several medals and certificates in the international and national level. According to the petitioner, the Government in G.O.Ms.No.639, dated 28.07.1993 has facilitated allotment of housing plots to such outstanding sportsman. Claiming benefits of the said G.O., the petitioner claims to have sent several representations to the respondents seeking for allotment of a housing plot and since the representation were not considered, the petitioner is before this Court.

2. Heard Mr.V.Raghavachari, learned counsel for the petitioner and Mr.Zakir Hussain, learned Government Advocate for respondents 1 & 2 and Mr.V.Anandhamurthy, learned Standing Counsel for TNHB/respondent 3.

3. Though the petitioner seeks for a larger prayer for the allotment of a plot in his favour, the leaned counsel for the petitioner would submit that the petitioner would be satisfied, if he is permitted to send a representation claiming benefits of the said G.O. to the respondent, and a direction may be given to the respondent to consider the same. The learned counsel for the 3rd respondent would also submit that in case such a representation is made to him in writing, the same would be considered in the light of its own merits.

In view of the submissions made by the respective counsels, the petitioner is permitted to make an application before the 3rd respondent seeking for allotment of housing plot in his favour and on receipt of the said application the 3rd respondent shall consider the same in the light of G.O.Ms.No.639, dated 28.07.1993, on its own merits and pass orders in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. It is made clear that I have not expressed any of my views with regard to the petitioners eligibility to claim the housing plot in his favour.

5. With the above observations, the Writ Petition is disposed of. No costs.
