Respondents Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a writ of mandamus directing the respondents 1 to 4 to remove the wrong entries in petitioner's patta lands in S.No.212/1, 122/2C2, 22, 292/1C1 in Kalukondapalli Village, Denkanikottah Taluk, Krishnagiri District of persons as owners as per Sl.No.10(1) of Tamilnadu Patta Passbook Act, 1983 as obtained from internet on 17.10.2021, 5 cents of Natham lands in S.No.122/1 as S.No.45/8 placing it in the hands of Kalukondapalli Panchayat the fifth respondent ignoring the objections of the petitioner through representations and to retain or to include the name of the petitioner as owner of the said lands in respect of respective pattas.

ORDER

This writ petition has been filed to issue a writ of mandamus directing the respondents 1 to 4 to remove the wrong entries in petitioner's patta lands in S.No.212/1, 122/2C2, 22, 292/1C1 in Kalukondapalli Village, Denkanikottah Taluk, Krishnagiri District of persons as owners as per Sl.No.10(1) of Tamilnadu Patta Passbook Act, 1983 as obtained from internet on 17.10.2021, 5 cents of Natham lands in S.No.122/1 as S.No.45/8 placing it in the hands of Kalukondapalli Panchayat the fifth respondent ignoring the objections of the petitioner through representations and to retain or to include the name of the petitioner as owner of the said lands in respect of respective pattas.

2. It is seen that the petitioner ought to have filed appeal before the Revenue Divisional Officer to cancel the patta issued in favour of the third parties in respect of the subject property.

3. Considering the same, the petitioner is directed to file appeal before the Revenue Divisional Officer concerned within a period of two weeks from the date of receipt of copy of this order. On receipt of the same, the Revenue Divisional Officer concerned is directed to issue notice to the petitioner and the counter parties and, after giving them opportunity of hearing, pass orders on merits and in accordance with law within a period of twelve weeks thereafter.

4. With the above directions, this writ petition is disposed of. No order as to costs.
