Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondent to consider the petitioner's representation dated 06.06.2016 for issuance of community certificate to her children, based on her certificate.

ORDER

(Order of the Court was made by HULUVADI G. RAMESH,J.) With the consent of both the parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. The prayer made in the writ petition is to issue a writ of Mandamus, directing the respondent to consider the representation of the petitioner dated 06.06.2016 for issuance of community certificate to her children, based on her certificate.

3. The case of the petitioner is that she belongs to Kattunayakan Community, which is notified as a Scheduled Tribes community. She already obtained a community certificate dated 04.04.2016 to the effect that she belongs to Kattunayakan Community. While so, she made a representation dated 06.06.2016 to the respondent, requesting to issue a community certificate to her children viz., (i)M.Sandhiya and (ii)M.Sanjay and the same is pending without any progress. Therefore, the petitioner has approached this Court with the present writ petition for the above stated relief.

4. Heard Mr.M.Ravi, learned counsel for the petitioner and Mr.R.Prathapkumar, learned Additional Government Pleader, who took notice for the respondent.

5. Considering the facts and circumstances of the case, we direct the respondent to consider the representation of the petitioner dated 06.06.2016 with regard to issuance of community certificate to her children viz., (i)M.Santhiya and (ii)M.Sanjay, by verifying the community status of the petitioner and pass necessary orders in accordance with law, after affording an opportunity of personal hearing to the petitioner, within a period of two months from the date of receipt of a copy of this order. The petitioner is at liberty to produce all the necessary documents in support of her claim to the respondent at the time of enquiry.

6. The writ petition is disposed of with the above direction. No costs.
