This emergent miscellaneous petition has been moved today by the petitioner institution to direct the respondents 7 & 8 to permit the 8 nonNEET students admitted in the petitioner institution for the year 2021-22 under lapsed seat category pursuant to the order in W.M.P.No.7778 of 2023 in W.P.No.11130 of 2022 to write the examinations commencing from 01.08.2024 onwards and continue their course in line with the orders of the Hon'ble Supreme Court in I.A.No.145151 of 2023 dated 19.01.2024, pending disposal of the writ petition.

The apprehension of the petitioner is that the respondent University has indicated that they will not be able to permit the non-NEET students admitted in the petitioner institution for the year 2021-22 under lapsed seat category to write the examinations commencing from 01.08.2024 onwards, unless permission is obtained from the Court. Since this Court by way of interim orders has permitted the nonNEET students admitted under lapsed seat category in the petitioner institution for the year 2021-22 to write their first/second year BHMS examinations, of course, subject to the outcome of the writ petition, this Court is inclined to give the interim direction as prayed for. Accordingly, this miscellaneous petition is ordered by directing the respondents 7 & 8 to permit the 8 non-NEET students admitted in the petitioner institution for the year 2021-22 under lapsed seat category pursuant to the order in W.M.P.No.7778 of 2023 in W.P.No.11130 of 2022 to write the examinations commencing from 01.08.2024 onwards and continue their course in line with the orders of the Hon'ble Supreme Court in I.A.No.145151 of 2023 dated 19.01.2024, and this direction will be subject to the outcome of the writ petition.
