Respondents PRAYER: This petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the 2nd and 3rd respondents to give protection to the safety of the person and property of the petitioners ensuring the safe residence of the petitioners at their houses at Chunampet Colony and Post, Kancheepuram District by taking action on the representation of the petitioners dated 03.05.2019 forwarded by the 1st respondent to the 2nd respondent on 12.06.2019. ORDER

The petitioner has been filed directing the 2nd and 3rd respondents to give protection to the safety of the person and property of the petitioners ensuring the safety of the person and property of the petitioners ensuring the safe residence of the petitioners at their house at Chunampet colony and Post,

Kancheepuram District by taking action on the representation of the petitioners dated 03.05.2019 forwarded by the 1st Respondent to the 2nd Respondent on 12.06.2019 and pass orders.

2. The case of the petitioner is that the petitioners are residing of Chunampet Colony and there was a land dispute between the 3rd petitioner and the neighbour Chitharasu. During the course of arguments the said Chitharasu stabbed the 3rd petitioner on his head, due to which the said Chitharasu sustained injuries and he died. Due to which the family members of the deceased Chithrarasu preventing the petitioners to enter into the said are and threatening them with dire consequences. Hence the petitioners filed a representation before the respondents on 03.05..2018 seeking police protection to petitioners. However, no action was taken against the officials concerned till date, which leads to filing of the present petition.

2. The learned counsel for the petitioner submits that as the petitioners are not able to reside in the said area peacefully, this Court may issue a direction to the respondent to consider the petitioners representation dated 03.05.2018 and pass orders.

3. The learned Government Advocate would submit that till date there is threat or apprehension to the petitioners. However the petitioners representation will be considered on merits and action will be taken as expeditiously as possible.

4. In the above facts and a representation having already been filed by the petitioners, there shall be a direction to the respondents/police to consider the petitioner's representation on its own merits and pass orders in accordance with law as expeditiously as possible from the date of receipt of copy of this order.

5. The Writ petition is disposed of with the above direction.
