O R D E R

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

The instant writ petition has been filed with a prayer for issuing a Mandamus, to consider the appeals submitted by the petitioner dated 17.03.2025 and 29.05.2025 to the 1st respondent and direct the 1st respondent to permit the petitioner to undergo Oral Tamil Language Test as allowed by TNEB service Regulations 91 (3) (i) (ii).

3. Heard the learned counsel for both sides and perused the materials available on record.

4. The learned counsel for the petitioner would submit that the petitioner was working as Contract Labour under the Respondents-Board from the year 1992 to 2008. Thereafter, he was appointed as Assessor Gr.II on 17.06.2010 and his probation was declared on 12.06.2013. Thereafter, the 2nd respondent herein vide his order dated 06.03.2025 has passed the final order discharging the petitioner from service. The petitioner has preferred appeals dated 17.03.2025 and 29.05.2025 before the 1st respondent against the order of the Original Authority, dated 06.03.2025 and such appeals are yet to be considered by the 1st respondent.

At this juncture, the learned Standing Counsel appearing for the respondents would submit that, the Appropriate Authority to consider the petitioner's appeals is Chief Engineer, Vellore Region, and that they have already forwarded the appeals received from the petitioner to the Chief Engineer, Vellore Region.

6. At this juncture, the learned counsel for the petitioner would submit that according to the TNEB Service Regulations, Chief Engineer Personnel is the Appellate Authority.

In such view of the above submissions, without going into the merits of the writ petition, this Court deems it appropriate to direct the 1st respondent to consider the petitioner's appeals dated 17.03.2025 and 29.05.2025 and pass orders on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.

8. With the above direction, the Writ Petition is disposed of. No costs. 09.07.2025 Index : Yes/No Speaking order /Non Speaking Order dm 4/6
