This petition has been filed seeking to condone the delay of 450 days in representing the above C.R.P.

2. Ms.C.Raniani, learned counsel for petitioner submitted that the petition was returned on 11.01.2022 for compliance of certain defects and in furtherance to the same, the petitioner has taken due process to rectify the defects. However, again it was returned on 01.02.2023 for non-filing of condone delay petition for filing the main C.R.P. In the meanwhile, the returned papers were mixed up with some other disposal bundles and thereafter, it was traced out. Hence he was not able to represent the petition in time. In view of the same, there is a delay of 450 days arose in representing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order. 06.10.2023 rpp https://www.mhc.tn.gov.in/judis
