Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the 1st respondent, herein to enforce the direction issued by him in the exercise of power under Tamil Nadu Societies Registration Act bearing Ref.No.1218/E1/07 pronounced on 26.06.2007, including for the proper conduct of the Annual General Meeting and the election by secret ballet of the office bearers to the 2nd respondent society in a meeting held within the jurisdiction of the 1st respondent.

O R D E R

This petition has been filed seeking for issuance of Mandamus directing the 1st respondent to enforce the direction issued by him in the exercise of power under Tamil Nadu Societies Registration Act bearing Ref.No.1218/E1/07 pronounced on 26.06.2007, including for proper conduct of the Annual General Meeting and the election by secret ballet of the office bearers to the 2nd respondent society in a meeting held within the jurisdiction of the 1st respondent.

2.Heard both sides.

3.On perusal of the records, it is seen that the petitioners have filed a suit before this Court in C.S.No.440 of 2008 along with O.A.No.470 of 008 and A.No.2147 of 2008 for conducting election and this Court by an order dated 19.12.2008 appointed Mr.M.Sowundarapandian as Advocate Commissioner for conducting election. However, it is submitted by the learned counsel for the petitioner that subsequently, the case has been transferred to City Civil Court.

4.In view of the subsequent transfer of the case, nothing survives for adjudication in this petition. Accordingly, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
