Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Certiorari, to call for the records of the respondents in connection with the impugned memorandum issued by the first respondent in Rc.No.224499/NGBIV(1)/03 dated 10.10.2003 in so far as permitting all the Head Constables who have completed four years of service, either permanent or officiating, in the range promotion board and quash the same.

ORDER

The petitioner-Mr.S.Balaian filed O.A.No.3993 of 2003 before the Tamil Nadu Administrative Tribunal, Chennai challenging the impuged memorandum issued by the first respondent in Rc.No.224499/NGB-IV(1)/ 2003 dated 10.10.2003 insofar as permitting all the Head Constables who had completed four years of service in the range promotion board and to quash the same. On the abolition of the Tribunal, the matter came on transfer and renumbered as the writ petition. https://hcservices.ecourts.gov.in/hcservices/

2. When the matter was taken up, the learned counsel for the petitioner fairly stated before this Court that since the Tribunal had not granted stay of the impugned memorandum dated 10.10.2003, the range promotion board had taken place, as a result, all the Head Constables who completed four years of service, either permanent or officiating, were allowed to participate. That apart, the petitioner, having taken part in the range promotion board selection, was found not coming within the zone of consideration. Moreover, the petitioner also retired from service on reaching the age of superannuation. Therefore, the prayer sought for in the writ petition has become infructuous.

3. Recording the above submissions, this writ petition is dismissed as infructuous. No costs.
