Respondent Appeal under Clause 15 of the Letters Patent, against the order dated 01.02.2016 made in W.P.No.3640 of 2016: Writ petition filed under Article 226 of the constitution of India praying this Hon'ble Court, to issue a writ of Mandamus, directing the respondent to dispose of the representation of the petitioner dated 09.01.2016 and consequently direct the respondent to revise the Pensionary Benefits of the petitioner based on the G.O.Ms.No. 562 Finance (Pay Cell) Department dated 28.09.1998 as per law within a date fixed by this Honourable Court.

JUDGMENT

(Judgment of the Court was made by HULUVADI G.RAMESH, J.) Heard the learned counsel for the appellant and the learned Government Advocate for the respondent.

2. It appears that on the ground of inordinate delay and laches, the learned single Judge has dismissed the writ petition praying for a direction to the respondent to consider his representation in accordance with law with regard to the extension of pensionary benefits as is available to others. The case of the appellant/writ petitioner is that he is entitled for higher pension, but his request has not been considered by the respondent. As such, we direct the appellant/writ petitioner to https://hcservices.ecourts.gov.in/hcservices/

make a representation to the respondent. It is for the respondent to consider the case of the appellant/writ petitioner and to pay the enhanced pensionary benefits on account of the Government Order issued from time to time and also if the petitioner is entitled for the arrears, if any, the same may be calculated and paid within a period of three months from the date of receipt of a copy of this order. The writ appeal stands disposed of. No costs.
