ORDER

(Order of the Court was made by S.M.Subramaniam J.) Writ of Mandamus has been filed to direct the 3rd respondent to cancel the patta issued against the public Road. High Court cannot conduct a roving enquiry in respect of the ownership of lands. For cancellation of patta, the petitioner has to approach the Revenue Divisional Officer under the provisions of Tamil Nadu Patta Passbook Act, 1983. The Revenue Divisional Officer has to conduct an enquiry by affording opportunity to all the parties and take a decision on merits and in accordance with law by passing orders. 2/4

2. Granting liberty to the petitioner to approach the Revenue Divisional Officer, the present writ petition is dismissed. No costs.
