This Writ Miscellaneous Petition has been filed seeking to modify the affidavit and subsequent order dated 30.08.2019 in W.P.No.27377 of 2009 that the subject landed property is situated in New Survey No.32/2 instead of in New Survey No.133/2 as referred in the above said order.

2. Learned Senior Counsel appearing for the petitioner submitted that, in paragraph Nos.5 and 6 of the order passed by this court in W.P.No.27377 of 2009 dated 30.08.2019, it is inadvertently mentioned as New Survey No.133/2, however the correct New Survey Number is 32/2. Due to this typographical error, the respondents are directing the petitioner to avail a clarification, regarding the inadvertent error for effective compliance of the order of this court dated 30.08.2019. Unless this clerical error is rectified, the petitioner will be greatly prejudiced and the order of this court could not be implemented. Further, the learned Senior Counsel submitted that the authorities are not complying with the directions of this court citing the said typographical error. Hence, the learned Senior Page No.1 of 3

3. Considering the above submissions made by the learned Senior Counsel appearing for the petitioner, the New Survey No.133/2 mentioned in paragraphs Nos.5 and 6 of the order dated 30.08.2019 in W.P.No.27377 of 2009 is modified as New Survey No.32/2.

4. Accordingly, this Writ Miscellaneous Petition is ordered and in other aspects, the order dated 30.08.2019 shall remain unaltered. Registry is directed to carry out the necessary correction in the order dated 30.08.2019 and issue a fresh copy of the order to the learned counsel for the parties.
