ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed, praying for issuance of a writ of mandamus, to direct the 1st respondent to dispose of petitioner's survey application dated 19.05.2025 to measure the land in the Sanjal Natham S.No.393/2, measuring an extent of about 3 cents of the house site Patta in Pennagaram Taluk, Dharmapuri District and to mark the boundaries of the subject property.

3. After submitting for a brief while, the learned counsel for the petitioner would submit that they seeks liberty of this Court to take out a fresh representation for conducting survey over the subject property.

At the outset, it is submitted by the learned Government Advocate for the respondents that, if the petitioner files a fresh representation, the same would be considered and appropriate orders would be passed within a time frame that may be fixed by this Court, which was agreed to by the learned counsel for the petitioner.

5. In view thereof, taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, the petitioner may file a fresh representation. There shall be a direction to the respondents, to consider the fresh representation if any filed by the petitioner, on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner and to any other interested persons/stake holders, within a period of eight (8) weeks from the date of receipt of a fresh representation from the petitioner. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.
