... Respondents Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus directing the Respondents to dispose of the Representation made by the Petitioner vide their letters dated 23.10.2003 and 01.03.2004. For Petitioner :

Mr.R.S.Pandiyaraj For Respondents:

Mrs.Rita Chandrasekar, for M/s.Aiyar & Dolia

O R D E R

The Petitioner has come up with this Writ Petition seeking a direction to the Respondents to dispose of his representations made vide Letters dated 23.10.2003 and 01.03.2004, seeking to consider his OTS proposal.

Today, when the matter is taken up for hearing, Mrs.Rita Chandrasekar, learned counsel appearing for the Respondents submitted that the OTS Scheme was once made available and it was in force for a period of one year. She further submitted that a decade has passed and the said Scheme is not available as on date.

The present Writ Petition is pending for nearly 14 years. As the OTS Scheme is not in existence for the present, directing the Respondents to consider the Petitioner's representations is not going to help him. Hence, the Petitioner is directed to pay the entire amount demanded by the Respondents, as on date, together with interest, within a period of 45 days from the date of receipt of a copy of this order. 4.

It is reported that an interim order has been passed and it has to be complied with. Since a finality has been arrived in this matter, this Court makes it clear that if the Petitioner has paid any amount towards outstanding dues, the same shall be given credit to his Loan Account, while paying the balance amount.

The Writ Petition is disposed of with the above direction and observation.

No costs.

Consequently, connected W.P.M.P.No.14038 of 2004 is closed.
