ORDER
The present writ petition is filed challenging the order dated 04.12.2024 passed by the first respondent bearing Letter No.7806911/Ni.A.2(2)/2024-4 and direct the respondents to release the unutilised lands comprised in Survey No.96/1 measuring an extent of 4.35 acres and comprised in Survey No.94/2 measuring an extent of 3.08 acres situated at Sundakkamuthur Village, Coimbatore taluk and district covered by Award Nos.3 and 4 of 1964 dated 13.07.1964 in favour of the petitioners in the light of G.O.(Ms).No.10 dated 23.01.2025 issued by the Government of Tamil Nadu.
2. Though the writ petition is filed praying for a writ of certiorarified mandamus, after submitting for a brief while, learned Senior Advocate for the petitioners seeks liberty to approach the Government under G.O.(Ms).No.10 dated 23.01.2025.
3. Learned Special Government Pleader would submit that it is always 3/7
open to petitioners to submit application before the Government under G.O.(Ms).No.10 dated 23.01.2025. If any such application is submitted by petitioners, the same would be considered by the appropriate committee and orders passed, if it is otherwise in order, in accordance with law.
4. In view thereof, this court is inclined to dispose of the writ petition with following directions:
i) It is open to the petitioners to submit application before the Govenrment under G.O.(Ms).No.10 dated 23.01.2025. On receipt of any such application, the appropriate committee would consider and pass orders, if it is otherwise in order, in accordance with law, within a period of three (3) months from the date of uploading of web copy without waiting for the receipt of certified copy.
ii) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioners and all other interested parties are left open. 4/7
5. Accordingly, the writ petition stands disposed of. There will be no order as to costs. Consequently, connected miscellaneous petitions are closed.
