Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the first respondent to dispose of the Transfer Sarfaesi Application No.55 of 2023 within a stipulated period.

(Made by the Hon'ble Chief Justice) Heard Mr.M.Velmurugan, learned counsel for the petitioner.

2. Learned counsel for the petitioner submits that the present petition is filed to seek directions against the Debts Recovery Tribunal II, Chennai to decide the Transfer Securitisation Application No.55 of 2023 expeditiously.

3. It is submitted that the said application is filed on 11.07.2022 by the borrower and the interim order is operating against the petitioner. The sale certificate is issued in favour of the petitioner.

4. We are not aware of the number of matters pending before the Debts Recovery Tribunal II, Chennai. It would not be appropriate to issue direction to decide a particular matter in a time bound

manner. However, the petitioner may make an application to the Debts Recovery Tribunal for taking up the matter expeditiously, which application shall be considered by the Debts Recovery Tribunal on its own merits, at the earliest.

5. The writ petition is disposed of.
