This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 46 days in filing the above Criminal Revision Case against the judgment dated 13.03.2025 passed in S.T.C.No.25 of 2018, on the file of Judicial Magistrate No.1, Salem.

2. Mr.L.Mouli, learned counsel for petitioner submitted that as he is a senior citizen, he was suffered with age old ailments and also due to lack of legal knowledge, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of June 2025, he gave papers to him, as a result of which, there is a delay of 46 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
