ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 01.10.2021 for the offence under Sections 394, 307 and 506(2) IPC in Crime No.492 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 30.09.2021 at about 9.00 p.m, defacto complainant along with his relative was proceeding in a motor cycle. At that time, they saw that the petitioner and his friend waylaying four workers belonging to other State and assaulted them with knives and robbed a sum of Rs.1000/- from them and escaped from the spot. Hence, the complaint.

3. The learned Counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case and that the co-accused/A2 was already granted bail by this Court in Crl.O.P.No. 20232 of 2021 on 28.10.2021 and that the petitioner has been suffering incarceration for more than 40 days from 01.10.2021. Hence, he would pray for grant of bail to the petitioner.

4. The learned Government Advocate would strongly object stating that the petitioner has got eight previous cases against him and he is a history sheeter.

5. Considering the nature of offence and the fact that the petitioner is a history sheeter and has got eight previous cases against him, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. -sd/- 16/11/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
