This Petition has been filed seeking to condone the delay of 92 days in filing the above Civil Miscellaneous Appeal.
2. Learned counsel for the petitioner/appellant submitted that the 1st respondent has remained exparte before the tribunal and hence notice to 1st respondent may be dispensed with. He has made an endorsement in the court bundle to that effect.
3. Heard the learned counsel appearing for the petitioner and Mrs.R.Srividhya, learned counsel who takes notice on behalf of the 2nd respondent.
4. The learned counsel for the 2nd respondent has no objection to condone the delay.
5. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same and also taking into consideration, the no objection expressed by the learned counsel for the 2nd respondent, the delay of 92 days in preferring the appeal is condoned. This petition is ordered as prayed for.
