ORDER

The transfer petition has been filed to withdraw IDOP.No.304 of 2023 pending on the file of the Principal District and Sessions Court, Tuticorin and transfer the same to the file of the Family Court, Chengalpattu. 2.Despite service of notice on the respondent in the above transfer 1/4

petition, the respondent has neither chosen to appear in person or through counsel. Hence, the respondent is called and set ex-parte. I have proceeded to hear the learned counsel for the petitioner. 3.The petitioner is the wife, who seeks transfer of IDOP.No.2023 filed by the respondent/husband before the Principal District and Sessions Court, Turicorin, to the file of the Family Court, Chengalpattu. The petitioner is a resident of Chennai and she expressed inconvenience to attend the proceedings at Tuticorin since she may have to travel long distance and additionally, she has to take care of her children. 4.I have gone through the affidavit filed in support of the transfer petition and I am satisfied with the reasons stated therein and in view of the petitioner having made out a prima facie case, I am inclined to transfer the proceedings as prayed for.

5.In the light of the above, the Transfer Civil Miscellaneous Petition is allowed and the case in IDOP.No.304 of 2023 is directed to be withdrawn 2/4

from the file of the Principal District and Sessions Court, Tuticorin, and transferred to the file of the Family Court, Chengalpattu. There shall be no order as to costs.
