The petitioners, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 294(b), 323, 324, 341 and 506(ii) of IPC in Crime No.225 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution as per the defacto complainant/Kalpana is that due to previous enmity, the petitioners have picked up a quarrel with her, during the quarrel, the petitioners have abused, assaulted the husband and son of the defacto complainant with hands and wooden log and also gave life threat to them. Hence the case.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and due to previous enmity, a false complaint has been given against them. Hence, he prayed for grant of anticipatory bail to the petitioners.

4.The learned Government Advocate (Criminal Side) for the respondent would submit that due to previous enmity, the petitioners have abused, assaulted the husband and son of the defacto complainant with hands and wooden log and also gave life threat to them. He would further submit that the injured have been discharged from the hospital. However, he prayed for grant anticipatory bail to the petitioners. 5.The learned counsel for the intervenor would vehemently oppose for grant of anticipatory bail to the petitioner stating that the petitioners have abused the daughter of the defacto complainant, who is aged 16 years, in the middle of the road. Hence, he prayed for dismissal of the petition.

6.Heard both sides and perused the materials available on record including the FIR.

7.Taking into consideration the facts and circumstances of the case and the nature and gravity of the offence and also the daughter of

the defacto complainant, aged 16 years was abused by the petitioners in the middle of the road, this Court is not inclined to grant anticipatory bail to the petitioners.

8. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed. 10.08.2023 vkr
