ORDER
This writ petition has been filed for the issuance of a Writ of Mandamus directing the first respondent to act upon the application submitted by the petitioner on 25.03.2025 wherein the petitioner is seeking for issuance of passport in his name.
2. Heard Mr.P.Muthamizhselvakumar, learned counsel for the petitioner, Mr.R.Sugumar, learned Central Government Standing Counsel for the the first respondent and Mr.R.Venkatesa Perumal, learned Government Advocate (Criminal Side) for the second respondent.
3. Learned Government Advocate appearing on behalf of the respondent submitted that an FIR came to be registered in Crime No.472 of 2021 for offences under Sections 294(b), 324 and 506(2) of IPC and the 2/4
petitioner is arrayed as A1. He further submits that the investigation has been completed and final report is going to be filed shortly before the concerned jurisdictional Court.
4. In the considered view of this Court, mere registration of FIR or pendency of investigation will not be a ground to deny issuance of passport to the petitioner. The law on this issue is now too well settled. In view of the same, there shall be a direction to the first respondent to act upon the application submitted by the petitioner dated 25.03.2025 and issue the passport to the petitioner if he satisfies all the other requirements, within a period of four weeks from the date of receipt of a copy of this order.
