This application has been filed to direct the respondents to furnish security for a sum of Rs.6,51,436.93/-, failing which, to order attachment of the immovable properties morefully described in the schedule to the Judges summons, pending disposal of the arbitration proceedings.

2. This Court by an Order dated 18.08.2020, directed the respondents to furnish security for a sum of Rs.6,51,436.93/- on or before 18.09.2020.

3. Despite the Order of this Court directing to furnish security, the respondents have not furnished any security and none appeared for the respondents.

4. It is submitted by the learned counsel for the applicant that the notice sent to the first respondent has been returned as died, hence, the properties of the second and third respondents alone may be attached and this application may be closed.

5. In view of the submissions made by the learned counsel for the applicant, there shall be an Order of attachment of the immovable properties which are described in the schedule of the second and third respondents and this application is closed.
