This writ petition has been filed for the issue of a writ of mandamus directing the respondents 1 to 3 to consider the representation made by the petitioner on 18.09.2021, wherein the petitioner wants to stop the 4th respondent from dealing with the property.

2.Heard Mr.M.J.Bissar Ahmed, learned counsel for the petitioner and Mr.B.Vijay, learned Additional Government Pleader for R1 to R3. 3.The grievance of the petitioner is that originally the mother had executed a settlement deed dated 29.07.2010 infavour of the petitioner. Thereafter, it was cancelled and the 4th respondent was attempting to deal with the property. Hence, the cancellation of the settlement deed was put to challenge before the Civil Court and the present writ petition has been filed to restrain the Sub Registrar from entertaining any documents.

4.In the considered view of this Court, a writ petition can never be entertained for the sake of getting an interim order, when the substantial dispute is before the 2 / 4

Civil Court and the interim order can be sought for only before the Civil Court. The law on this issue is too well settled.

5.This Court does not find any merits in this writ Petition and accordingly, this writ petition stands dismissed. No costs.
