PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 2nd respondent to consider the petitioner's representation dated 06.12.2021 and add the missing survey number 45/ 3B1 measuring 0.70 Ares in online Patta also direct the 1st respondent to consider the petitioner's representation dated 25.04.2024, and conduct proper enquiry, specifically by taking appropriate departmental action against the respondents 4 to 7 for unnecessarily wavering the petitioner for past 3 year to their office and willful negligence in considering the Petitioner's complaint dated 06.12.2021.

The petitioner herein seeks a direction to 2nd respondent to consider his representation dated 06.12.2021 seeking inclusion of missing Survey No. 45/ 3B1 in the online patta issued to the petitioner in Patta No.6339, Okkiam Thoraipakkam Village, Sozhinganallur Taluk, Chennai District. The petitioner 2/6

also seeks a direction to consider his representation dated 25.04.2024 to conduct enquiry and take appropriate departmental action against the respondents 4 to 7 for their failure to consider the representation of the petitioner dated 06.12.2021.

2. When the writ petition is taken up for hearing, the learned Special Government Pleader appearing for the respondents 1 to 3 produced fresh online patta issued in the name of petitioner by including the Survey No. 45/ 3B1 in Patta No.6339. The copy of the same was also handed over to the counsel for the petitioner. In view of the inclusion of missing Survey No. 45/ 3B1 in Patta No.6339, the 1st part of the prayer in the writ petition seeking direction to consider the petitioner's representation dated 06.12.2021 has become infructuous.

3. The 2nd respondent herein filed a status report before this Court stating that due to pendency of large number of petitions and shortage of staff, the representation of the petitioner could not be considered within a reasonable time. The 2nd respondent also tendered his unconditional apology for his failure 3/6

to consider the representation within reasonable time. The status report filed by the 2nd respondent and his unconditional apology tendered therein are recorded. Accordingly, no direction is required in respect of 2nd prayer of the petitioner seeking consideration of his representation dated 25.04.2024 for taking departmental action against the respondents 4 to 7.

4. In view of the above, the writ petition stand disposed of by recording the status report filed by the 2nd respondent. No costs. 18.09.2024 Index : Yes/No nr 4/6
