The 4th defendant in C.S.No.183 of 2021 is the applicant herein.

2. The petitioner/4th defendant is stayed at his resident at MRC Nagar,Chennai and he claims that he has been residing in Malaysia and during his visit in the month of July, he came to Chennai and got to know about the acts. He has also stayed assigned reasons at Para Nos.9 & 10 in the affidavit.

3. From the records, I find that he was set exparte on 31.10.2023. The suit for partition was filed and the 4th defendant is the one of the share holder. Thus an opportunity should be given.

4. The learned counsel for the respondent has no objection for allowing the petition.

5. The learned counsel for the applicant stated that the written statement is filed along with necessary petition to condone the delay as required.
