This application has been filed seeking leave to sue the defendants 3 and 4 who are residing outside the jurisdiction of this Court.

2. The suit has been filed for partition. Item No.1 of the suit schedule property which is situated in Chennai is within the jurisdiction of this Court and the other items in the suit schedule property are situated outside Chennai.

3. The 1st and 2nd defendants are also residing within the jurisdiction of this Court. Excepting for 3rd and 4th defendants who are residing outside the jurisdiction of this Court, major part of cause of action have arisen only within the jurisdiction of this Court. Since one of the properties is situated within the jurisdiction of this Court and the defendant 1 and 2 are also residing within the jurisdiction of this Court, this Court is inclined to grant leave as prayed for. Accordingly, A.No.4126 of 2021 is allowed as prayed for.

4. Registry is directed to number the Suit, if it is otherwise in order and list the same.
