These applications have been filed to condone the delay in seeking to set aside the abatement caused; to set aside the abatement caused due to the death of the first respondent and to bring the legal heirs of the deceased first respondent on record.
2.Since the first respondent died during the pendency of the Original Petition and therefore, his legal heirs are necessary parties to be brought on record, the delay is condoned and the abatement is set aside and the application to bring the legal heirs of the first respondent on record is also ordered.
3.In fine, all the applications are ordered as prayed for.
4.Registry is directed to permit the applicant to carry out necessary amendment and file amended copy of the petition and after amendment, issue fresh summons to the newly added parties by Registered Post returnable by 20.12.2023.
