When the matter was taken up for hearing today, the learned Government Advocate(Crl. Side) submits that the defacto complainant's father died in the construction site where A1 was contractor and A2 was mason and as on date, the petitioner was not considered as accused. He would further submit that the A1 provided an agreement stating that the petitioner is the sub-contractor. As regards whether the agreement is dubious, the investigation is going on.

In view of the above submissions made by both the counsels and considering the fact that no FIR has been registered as against the petitioner and so far, he has not been impleaded as accused and there is no apprehension of arrest, the question of granting anticipatory bail would not arise.

Therefore, this Criminal Original Petition is dismissed.
