This petition has been filed to condone the delay of 11 days in filing the CMA against the award dated 01.03.2024 made in MCOP.No.854 of 2019 on the file of the Exclusive Motor Accidents Claims Tribunal, Dharmapuri.

2. Though the names of the respondents 3 and 4 are printed in the cause list, no one appeared on their behalf.

3. Mr.C.Palanisamy, learned counsel takes notice for the first respondent. Heard the learned counsel for the appellant and the learned counsel for the first respondent.

4. In view of the endorsement made by the learned counsel for the appellant, notice to the second respondent is dispensed with, since he remained ex-parte before the Tribunal.

5. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Court is inclined to order this petition.

6. Accordingly this Petition is ordered. Registry is directed to number the appeal, if it is otherwise in order and post the main appeal for admission. It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, she would not be entitled to any interest for the above 11 days.
