ORDER
The petitioner, who was arrested and remanded to judicial custody on 18.06.2025, for the alleged offence punishable under Sections 406, 420 & 506(1) of IPC in Crime No.22 of 2025, on the file of the respondent police, seeks bail.
2. Pending bail petition, at request of parties, the matter was referred to mediation for settlement, subsequently, the parties themselves arrived at a compromise. In mediation process, a Memorantum of Understanding dated 07.11.2025 has also been entered into between the petitioner and the defacto complainant. The defacto complainant has no objection for granting bail to the petitioner herein. It is also reported that some of the original documents have been deposited by the petitioner before the Registry of this Court. Since a compromise has been reached between the parties, the petitioner is also at liberty to get back of the same. The Registry is directed to return the same upon request.
3. Considering above fact, and the petitioner is in custody from 18.06.2025, I am inclined to grant bail to the petitioner on the following conditions:
4. Accordingly, the petitioner is ordered to be released on bail on his 2/6
executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, each for a like sum to the satisfaction of the learned XVIII Metropolitan Magistrate, Saidapet, Chennai, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] Since the conditions imposed by this Court have already been complied with, the petitioner is directed to appear before the respondent police as and when required. [c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 3/6

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
