PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first and second respondents to take action on the petitioners representation dated 15.04.2025 to curb the illegal operation of the 3rd respondent bus TN65/AL-1039 permitted to ply on the town service route number 91-B " Krishnammal College women's hostel to Sundakkamuthur." forthwith and pass orders.

ORDER
Mr.M.Shajakhan, Special Government Pleader takes notice for the first and second respondents.
2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.
3.This Writ Petition is filed seeking for a Writ of Mandamus directing the first and second respondents to take action on the petitioner's representation dated 15.04.2025, to curb the illegal operation of the 3rd respondent bus TN-65/AL-1039 permitted to ply on the town service route number 91-B " Krishnammal College women's hostel to Sundakkamuthur."
4. The petitioner is a stage carriage operator plying the bus registered as TN-37/BU-2277 on the route S-14" Avarmpalayam to Kovipudur via Gandhipuram. The third respondent is also a stage 2/6
carriage operator in respect of vehicle number TN-65/AL-1039, plying between the 91-B"PSG Krishnammal Women's College Hostel to "Sundakkamuthur" with IST between "PSG Krishnammal Women's College hostel to "Sundakkamuthur" . While so, the third respondent changed the route of her bus as 9-A instead of 91-B and was operating all the trips between Koviapudur to Gandhipuram as cut service, thereby interrupting the petitioner's route. Since the third respondent was plying the bus in an unauthorised route, the petitioner submitted a representation on 15.04.2025, to the first and second respondents, complaining of the illegal operation of the third respondent, on a route other than the permitted route. The Deputy Transport Commissioner on 22.04.2025 issued a letter to the first respondent to take action on the petitioner's complaint. Despite the letter of The Deputy Transport Commissioner, the first respondent, did not take any action. Therefore, the petitioner filed the present writ petition for the above said relief.
5. The learned counsel for the petitioner prayed that a direction may be issued to the second respondent, to consider the petitioner's representation dated 15.04.2025, within a time frame fixed by this Court. 3/6

Considering the facts and circumstances of the case and the limited prayer sought for by the petitioner's counsel, this Court without going into the merits of the case, directs the second respondent to consider and pass orders on the petitioner's representation dated 15.04.2025, by affording an opportunity of hearing to the petitioner as well as the third respondent, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
7. Accordingly, this writ petition is disposed of. However, there shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
