PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to receive the application of the petitioner dated 26.6.2016 in Form CCPA and the prescribed fee for the grant of Auto Rickshaw permit and to consider the same. For Petitioner : Mr. M.Haribabu For Respondent : Mr.S.Diwakar, SGP

ORDER

Mr.S.Diwakar, learned Special Government Pleader accepts notice for the respondent. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. This petition has been filed seeking a direction to the respondent to receive the application of the petitioner dated 26.06.2016, in Form CCPA and the prescribed fee for the grant of Auto Rickshaw permit.

3. The Special Government Pleader appearing for the respondent has produced a copy of the communication sent by the Transport Commissioner to the Joint Commissioner, Chennai North and South Zones dated 21.7.2016 wherein the direction has been issued to the Regional Transport Officers in Chennai North and South Zones to receive applications for the grant of auto rickshaw permit and to pass orders without giving any room for further complaints.

4. In the light of the above instructions, there may not be any necessity to issue a separate direction as sought for by the petitioner, as a general circular has already been issued by the Transport Commissioner.

5. Accordingly, the Writ Petition stands disposed of by directing the respondent to abide by the said circular issued by the Transport Commissioner. No costs.
