O R D E R
This writ petition is filed for a direction to the first respondent to consider and pass order on the petitioner's representation dated 05.06.2025, seeking name change and other particulars of the petitioner's deceased husband namely "N.Pencilaiah III" in the death certificate dated 22.06.2022, issued by the 1st respondent.
2. The petitioner's husband deceased N.Pencilaiah III, retired from the services of Southern Railway, on 31.03.2015. The petitioner states that her husband was mentally unstable and abandoned her during the year 2021. The petitioner was totally unaware of the whereabouts of her deceased husband, until recently, when she came to know that her husband died in the 3rd respondent's old age home, on 25.05.2022. The petitioner states that the 1st respondent issued the death certificate of her husband on 22.06.2022. The petitioner states that in the said death certificate the name of the petitioner's husband was wrongly entered as "Narayanan s/o.Narasimmaiah" 2/6
instead of "N.Pencilaiah III". Therefore, the petitioner submitted a representation to the first respondent on 05.06.2025, for rectifying her husband's name in the death certificate issued on 22.06.2022. Since, no action was taken on the petitioner's representation, she filed the present writ petition.
3. The learned Special Government Pleader appearing for the first respondent submitted that the petitioner may be directed to submit the supporting documents, enabling the 1st respondent to consider the representation and pass orders.
4. Heard the learned counsel for the petitioner and the learned Special Government Pleader for first respondent and the learned Government Advocate for second respondent. With consent of all counsels, this writ petition is taken up for final disposal.
5. Considering the facts and circumstances of this case, this Court is inclined to issue the following directions :- (i)The petitioner is directed to submit the supporting documents for name change and address change in the 3/6
death certificate dated 22.06.2022 of her husband within a period of two weeks, from the date of receipt of a copy of this order.
(ii)On receipt of such supporting documents from the petitioner, the first respondent shall pass orders on the petitioner's representation dated 05.06.2025, on merits and in accordance with law, within a period of four weeks, thereafter.
6. With the above directions, this writ petition is disposed of. No costs.
