Respondents Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari, to call for the records the notice pertaining to the appeal preferred by the 3rd respondent herein before the 1st respondent herein in Appeal No.3604/Aa1/2021 dated 12.10.2021 against the order passed by the 2nd respondent herein / District Registrar (Administration), Kancheepuram dated 15.02.2020 in Na.Ka.No.289/A2/2020 seeking to decide the title of Plot No.447, The Sea Shore Town, Sholinganallur Village, Kancheepuram District and quash the same.

ORDER

This Writ Petition has been filed for issuance of Writ of Certiorari, calling for the records, the notice pertaining to the appeal preferred by the third respondent before the first https://hcservices.ecourts.gov.in/hcservices/

respondent in Appeal No.3604/Aa1/2021 dated 12.10.2021 against the order passed by the second respondent / District Registrar (Administration), Kancheepuram, dated 15.02.2020 in Na.Ka.No.289/A2/2020 seeking to decide the title of Plot No.447, The Sea Shore Town, Sholinganallur Village, Kancheepuram District and quash the same.

2. The petitioner challenging the impuged notice issued by the first respondent for enquiry to be conducted on 11.11.2021. However, the petitioner could not be able to appear before the first respondent on 11.11.2021. The third respondent filed an appeal before the first respondent as against the order passed by the second respondent. In which the first respondent had taken on file No. 3604/Aa1/2021 and issued notice to the petitioner for enquiry.

3. In view of the above, this Court finds no infirmity or illegality in the notice issued by the first respondent on the appeal filed by the third respondent. Therefore, the writ petition is devoid of merits. However, the first respondent is directed to issue fresh notice to the petitioner and the third respondent within a period of two weeks from the date of receipt of a copy of this order and conduct enquiry, after giving them an opportunity of hearing, shall pass orders on merits and in accordance with law, within a period of twelve weeks thereafter.

4. With the above direction, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No order as to costs.
