ORDER
This Writ Petition Criminal is filed to direct the 1st respondent to provide adequate police protection enabling the 2nd and 3rd respondents to carryout the survey of the petitioner's properties comprised in S.No.10/2 measuring to an extent of
0.10.00 hectares, S.No.10/3A measuring to an extent of 0.29.95 hectares and S.No.11/12A measuring to an extent of 0.03.24 hectares, situated at Pasthalapalli Village, Shoolagiri Taluk, Krishnagiri District and fix the boundaries and to avoid any hindrance caused by the respondents 4 to 10 at the time of surveying his properties by considering the representation dated 01.06.2026, within a stipulated period.
2.The petitioner herein owned the properties comprised in S.No.10/2, measuring an extent of 0.10.00 hectares, S.No.10/3, measuring an extent of 0.29.95 hectares, and S.No.11/12, measuring an extent of 0.03.24 hectares, situated at Pasthalapalli Village, Shoolagiri Taluk, Krishnagiri District, having acquired the same by virtue of a Settlement Deed dated 24.08.2005, registered as Doc.No.1802/2005. He further submitted that, pursuant to a Partition Deed dated 10.09.2024, registered as Doc.No.6206/2024, the said properties were divided among the grandsons. While so, respondent Nos.4 to 10 attempted to interfere with the petitioner's lawful possession of the subject property. With a view to legally demarcate the boundaries, the petitioner submitted an application before the second respondent, along with the requisite fee, to survey the land. Though the second respondent engaged the third respondent to survey the disputed land, respondent Nos.4 to 10 objected to the surveyor surveying the petitioner's property.
3.In view of the above, if the surveyor faces any difficulty at the hands of respondent Nos. 4 to 10, he may seek police protection from the first respondent. Upon receipt of such a request, the first respondent shall conduct an enquiry and pass appropriate orders for providing adequate police protection while surveying the petitioner's land, in accordance with law. 4.Accordingly, this Writ Petition is disposed of.
