The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.81 of 2019 seeks anticipatory bail.
2. The petitioner has been arrayed as A2 in this case. The learned counsel for the petitioner stated that the petitioner has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
3. The learned Government Advocate (Criminal Side) stated that on 07.09.2019, about 11 Kgs of Ganja had been seized by the respondent police from A1. The petitioner herein had dropped the bag and had escaped from the place of occurrence. He also stated that 12 Kgs of Ganga had been seized by the respondent police from the bag which was dropped by the A2/petitioner herein. Hence, he opposed this petition.
4. The petitioner is an accused in Spl.C.C.No.2 of 2022 on the file of Special Judge for EC and NDPS Cases, Salem in which after investigation, charge sheet had been filed showing that the petitioner as an absconding accused. Non-Bailable Warrant is also pending against the petitioner herein.
5. In view of these facts, the anticipatory bail will not lie. Accordingly, this Criminal Original Petition stands dismissed. 06.11.2023 mkn2/sli
