A.No.3881 of 2022 is filed for reception of certain documents mentioned in the applications as documents on the side of the defendants. It is seen that this case is pending for examination of witness on the side of the defendants. When that be the position, this application is filed for reception of documents. 2.The learned counsel for the respondents opposed this application on the ground that all the documents filed are xerox copies and that these documents have no connection with the dispute involved between the parties. It is admitted position that xerox copies of the documents cannot be marked. Secondary evidence can be admitted in the evidence subject to the compliance of relevant Provisions of Indian Evidence Act with regard to non-production of original documents. Thus, this Court allows this application and the concerned learned Master is directed to receive these documents subject to the admissibility, relevancy and proof. Accordingly, this application is allowed. Send the matter to the concerned learned Master for recording evidence. G. CHANDRASEKHARAN, J.
