ORDER

(Order of the Court was made by S.M.Subramaniam J.) The Notice under Sections 56 and 57 of the Tamil Nadu Urban Local Bodies Act, 1998 in proceedings dated 25.07.2024 is under Challenge in the present writ petition.

2. Pertinently, patta issued in favour of the petitioner was cancelled. The authorities found irregularities in grant of patta, and further, the constructed building is also unauthorized.

3. No writ against notice is entertainable in a routine manner unless such notice has been issued by an incompetent authority having no jurisdiction or tainted with the allegations of malafides. The petitioner, instead of producing documents before the authorities and participate in the inquiry, has chosen to file the writ petition with the apparent intention of prolonging and protracting the enforcement actions to be initiated under the relevant provisions of the Act.

4. Therefore, this court is not inclined to entertain the writ petition. If the petitioner possess any document, he is at liberty to produce the same before the authorities. However, the respondents are directed to continue the enforcement actions and remove the unauthorized constructions by following the proceedings. The said exercise is directed to be completed within a period of

eight (8) weeks from the date of receipt of a copy of this order.
