A.No.4131 of 2023 in C.S.(Comm.Div.).DR.No.85841 of 2023 P.T. ASHA, J, The above application is filed to grant leave to the Plaintiff to sue against the Respondent/Defendant for the reliefs sought for by the Plaintiff in the above suit to the Judge's Summons before this Hon'ble Court.

2. The leave to sue application by itself is redundant since the suit is one for infringement. Under Section 134(2) of the Trademark Act, the place where the plaintiff carries on business also confers jurisdiction for instituting an infringement suit. The plaintiff in the instant case carries on business within the jurisdiction of this Court. Therefore, the leave to sue application is dismissed as redundant.

3. The Registry is directed to number the suit if it is otherwise in order.
