ORDER
This Criminal Revision has been filed as against the order dated 23.06.2025 made in Crl.M.P.No.1172 of 2025 on the learned Judicial Magistrate Court No.I, Tirupattur, thereby dismissing the petition for return of property.
2. The petitioner is owner of car bearing Reg.No.TN-02-AF-0765 which was used by the accused for transporting illicit liquor from the State of Karnataka. Hence, FIR was registered in Cr.No.87/2025 for the offences punishable under Section 4(1)(a), TNP Act. In pursuance of registration of FIR, the respondent seized the said car and deposited before the trial Court. The petitioner being the owner of the car filed a petition to return the property. However the trial Court dismissed the same. Aggrieved by the same, the present revision has been filed.
3. The learned Government Advocate submitted that respondent has initiated confiscation proceedings under the Tamil Nadu Prohibition Act and it is pending.
4. Since confiscation proceedings are pending this Court is not inclined to allow this petition. The trial Court rightly rejected the application for return of property and this Court finds no illegality or infirmity in the order passed by the trial Court.
