ORDER

Heard the learned counsel appearing on behalf of the petitioner, as well as the learned Additional Government Pleader appearing on behalf of the respondents.

2. This Writ Petition has been filed praying that this Court may be pleased to issue a Writ of Mandamus to direct the respondents to permit the petitioner for certificate verification, for being selected to the post of Graduate Teacher Post.

3. The learned counsel appearing on behalf of the petitioner submitted that the petitioner is fully qualified to the post of Graduate Teacher. However, proper communication had not been issued to her, in time. Therefore, this Court has passed an interim order of direction, on 06.07.2012, directing the respondents to keep one post of Graduate Teacher (Tamil) vacant.

A counter affidavit has been filed on behalf of the first respondent stating that a call letter was issued to the petitioner, by way of telegram, dated 30.06.2012, calling the petitioner for certificate verification, on 01.07.2012. However, the petitioner had not turned up for the certificate verification. Therefore, the Teachers Recruitment Board did not consider the petitioner for selection. It has been further stated that, from the year, 2012 onwards, Teachers Eligibility Test has come into force, for the recruitment of the teachers. Therefore, the petitioner has to take part in the recruitment process, if she is qualified to participate in such recruitment when fresh notifications are issued for such posts. However, the relief prayed for by the petitioner in the present Writ Petition cannot be granted, at this stage.

In view of the averments made in the Counter Affidavit and in view of the submissions made by the learned Additional Government Pleader appearing for the respondents, this Court is of the considered view that the relief prayed for by the petitioner cannot be granted, at this stage. It may be open to the petitioner to participate in the process of selection if she is qualified, when notifications are issued, in future, by following the procedure established for such selection, including the Teachers Eligibility Test.

6. The Writ Petition stands dismissed with the above observation. No costs. Connected M.P.Nos.1 and 2 of 2012 are closed.
