Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus, to direct the Respondents to Amend correct the petitioner's Class X Marksheet / Grade Sheet cum Certificate of Performance (Session 2013-15) bearing S.No.SSE / 2015 0221075, Roll No.4002067 and bearing Registration No.M115 / 06928 / 0100 to reflect the correct name of the petitioner's father i.e., Ramamurthy Iyer.

ORDER
The writ petition has been filed seeking direction to the respondents to correct the petitioner's Class X Marksheet / Grade Sheet cum Certificate of Performance (Session 2013-15) bearing S.No.SSE / 2015 0221075, Roll No.4002067 and bearing Registration No.M115 / 06928 / 0100 to reflect the correct name of the petitioner's father i.e., Ramamurthy Iyer.
2. The petitioner was born to Mr. Ramamurthy Iyer and 2/8
Mrs.Srividya. Though the petitioner name was enrolled in School as Gopalakrishnan Ramamurthy, son of Ramamurthy Iyer, in his class X Marksheet/Certificate, his father's name has been erroneously recorded as "Ramamurthy" instead of "Ramamurthy Iyer".

It is submitted that in all other educational records, including his Senior Secondary Certificate and other educational certificates, his father's name has been correctly recorded as "Ramamurthy Iyer". Therefore, the petitioner seeks correction of his father's name in the Secondary School Examination Marksheet (Class X) to reflect the correct name as "Ramamurthy Iyer".
4. The learned counsel for the petitioner submitted that the petitioner has recently applied to travel abroad and during the document verification process, the discrepancy in his father's name in the Class X certificate came to light, causing undue hardship.
5. As per Rule 69(1) of the Examination By-Laws of the Central Board of Secondary Education (CBSE) empowered to make corrections 3/8
and changes in names. The relevant portion of By-Laws is as follows: "69.1 Changes and Corrections in Name (i) Correction in name means correction in spelling errors, factual errors, typographical errors in candidate's Name /Surname, Father's Name/Mother's Name to make it consistent with what is given in the school record.
Change in name also includes alteration, addition, deletion to make it different from the school records.
(ii) Application for correction in name may be considered any time provided that the application of the candidate is forwarded with the following documents:
(a) Admission form(s) filled in by the parents at the time of admission.
(b) The School Leaving Certificate of the previous school submitted by the parents of the candidate at the time of admission.
(c) Portion of the page of admission and withdrawal register of the school where the entry has been made in respect of the 4/8
candidate.
(iii) The Board may effect necessary corrections after verification of the Original records of the school and on payment of the prescribed fee.
(iv) Applications regarding change in name/surname will be considered where such changes have been permitted by a Court of Law and notified in a Government Gazette. In the event of Court of Judicature allowing the change of name of a candidate, the same shall be carried out by the Board after obtaining relevant documents concerning change of name published in the official gazette."
6. Despite the petitioner having submitted a representation along with supporting documents to 1st and 2nd respondents seeking correction of his father's name, no action has been taken till date. 7.
In view of the above, the 1st and 2nd respondents are hereby directed to consider the representation of the petitioner and carry out the correction of his father's name as "Ramamurthy Iyer" in his Class X marksheet and certificate, within a period of four weeks from the date of 5/8
receipt of a copy of this order.

With the above directions, this Writ Petition is disposed of. No costs.
