Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 2nd respondent to promote the petitioner as Superintendent as per the panel issued in No.7392/A1/2013-2 dated 29.07.2013 passed by the 2nd respondent. Though the relief sought for in this writ petition is for a direction to the 2nd respondent to promote the writ petitioner to the post of Superintendent in the regular cadre. The learned counsel for the writ petitioner restricts the prayer by stating that it is suffice, if a direction is issued to the 1st respondent to consider the representation submitted by the writ https://hcservices.ecourts.gov.in/hcservices/
petitioner in this regard in respect of granting promotion to the post of Superintendent.
2.Further, the learned counsel for the writ petitioner states that the writ petitioner was actually promoted as Superintendent with effect from 22.02.2016 and thereafter, retired from service on attaining the age of superannuation dated 30.04.2017. Thus, without going into the merits of the matter, the 1st respondent is directed to consider the representations submitted by the writ petitioner on 10.09.2013 and on 16.09.2013 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is also directed to enclose the copies of the representation along with the orders passed in this writ petition.
3.Accordingly, the writ petition stands disposed of. However, there shall be no order as to costs.
