The rights of the petitioners are protected only under Section 52 of the Transfer of Property Act, which makes alienation pending suit or appeal, subject to result of the suit or appeal.

Hence, we do not see any reason to grant an order of injunction. This petition is therefore, dismissed.

2.It is made clear that any alienation made, will be subject to result of the appeal.
